Right of withdrawal

This notice applies to consumers. The contract for the use of NeuroScreen is a contract for digital services concluded at a distance. We grant you the right of withdrawal set out below — even though the Service is currently provided free of charge.

Right to withdraw

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract — that is, the day on which your registration was confirmed.

To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an e-mail). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

As the Service is currently provided free of charge, as a rule no payments and therefore no reimbursements arise. After withdrawal we cease providing the Service, delete your account and the associated measurement data in accordance with the Privacy Policy, and make no further use of content you provided, unless it is usable only within the Service, concerns anonymised analyses you generated, or statutory retention obligations apply.

Early expiry of the right of withdrawal

In the case of a contract for the supply of digital content or digital services, the right of withdrawal expires early if we have begun performance of the contract after you have

1. expressly consented to us beginning performance before the end of the withdrawal period, and
2. acknowledged that you thereby lose your right of withdrawal once performance begins.

We obtain this consent expressly during registration, before the measurement features are unlocked for you. If you do not give it, the Service will be available to you in full once the withdrawal period has elapsed.

Withdrawal from the contract must be distinguished from withdrawing data protection consents. You may withdraw consents independently of the right of withdrawal, without any deadline, at any time with effect for the future — see Consent to the processing of EEG and health data.
